What Is Maintained Status in Canada? Can You Stay After Your Permit Expires?

Published by: Can X Global Solutions Inc.

If you are living in Canada on a temporary permit such as a work or study permit, you might wonder what happens if your permit expires while your renewal application is still being processed. Fortunately, Canada’s immigration system has an important protection called Maintained Status that allows you to stay legally in Canada during this period.

This blog explains what maintained status is, who qualifies for it, how it works for different types of permits, and the key rules to keep in mind.

What Is Maintained Status in Canada?

Maintained status (formerly known as implied status) is a legal provision that lets temporary residents stay in Canada legally while their application to extend or change their permit is being processed, provided they apply before their current permit expires.

This means if you submit your application for renewal or status change on time, even if your permit expires while IRCC processes your application, you continue to have legal status and can stay in Canada.

Who Is Eligible for Maintained Status?

Maintained status applies to most temporary residents who applied to extend or change status before their current permit expired, including:

    • Temporary foreign workers applying to extend their work permit
    • International students applying to renew their study permit
    • Visitors applying to extend their visitor status
    • Those changing their permit type or conditions (e.g., from study permit to work permit)

Important: You must be physically inside Canada during this time. Leaving Canada may cancel your maintained status.

How Does Maintained Status Work?

For Work Permit Holders

If you apply to extend or change your work permit before your current permit expires and remain in Canada:

    • You can keep working under the same conditions as your expired permit (same employer, job, location) while your application is processed.
    • If your new application is for a different employer or job, you must stop working when your old permit expires and wait for approval.

For International Students

If you apply to extend your study permit before it expires:

    • You can continue to study at the same institution and under the same conditions while waiting for the decision.
    • If you apply for a new study program or change schools, you must stop studying when the old permit expires until the new permit is approved.

For Visitors

If you apply to extend your visitor status before expiry:

    • You can remain legally in Canada during the processing period.
    • However, you may not have permission to work or study unless explicitly authorized.

What Happens If You Apply After Your Permit Expires?

If you miss the deadline and submit your renewal or change application after your permit has expired, you:

    • Lose maintained status and your stay becomes unauthorized
    • Must immediately stop working or studying
    • Can apply for restoration of status within 90 days of expiry, but this is not guaranteed and may take additional time
    • Risk being ordered to leave Canada if you do not restore your status

Important Rules to Remember About Maintained Status

    • Apply before your current permit expires: Your application must be submitted online and received by IRCC before midnight UTC on the day your permit ends.
    • Stay inside Canada: Leaving the country usually cancels maintained status.
    • Maintain the same conditions: You can only do what your expired permit allowed (same job, same study program).
    • Maintained status applies only to temporary permits: It does not cover permanent residency applications or Temporary Resident Permits (TRPs).

Why Is Maintained Status Important?

Maintained status protects you from losing legal status during processing delays. It allows you to:

    • Avoid gaps in your immigration status
    • Continue legally working, studying, or visiting
    • Prevent removal orders or future bans
    • Feel more secure while awaiting IRCC’s decision

Conclusion

Maintained status is a key safeguard for temporary residents in Canada, allowing you to stay while your extension or status change application is processed. To benefit from it, you must apply on time and comply with your current permit’s conditions.
