To be eligible for restoration of status in 2025, you must meet these conditions:

    • Apply within 90 days of losing your status (the date your permit expired or conditions were broken).
    • Complied with all conditions of your previous permit until it expired (for example, if you were a student, you didn’t work illegally; if you were a worker, you didn’t break work conditions).
    • Are not a Temporary Resident Permit (TRP) holder.
      Remain in Canada during the restoration period; you cannot leave Canada and re-enter on a restoration application.

Special Exemption (Provincial Nominee Program candidates):

Some foreign workers supported by certain provincial or territorial nomination programs may still apply for restoration even if over 90 days have passed, if they have a specific support letter. These cases are rare and have different requirements.

Who Is Not Eligible?

    • Individuals who miss the 90-day deadline (unless exempt through a participating provincial program) must leave Canada and reapply from overseas.9
    • Those with criminal inadmissibility, misrepresentation, or other serious violations are not eligible for restoration through standard channels.

Restoration of Status: Step-by-Step Application Process

Step 1: Confirm Your Eligibility and Prepare to Act Quickly

    • Double-check your expiration date and act immediately if you discover you’re out of status.
    • If it’s been less than 90 days, proceed with a restoration application.
    • Do not continue working or studying while waiting for a restoration decision. Maintained (implied) status does not apply to restoration applications.

Step 2: Gather Required Documents

You will need to include well-prepared, accurate documents in your restoration application, such as:

    • Application Form:

      • For workers: IMM 5710 “Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker.”
      • For students: IMM 5709 “Application to Change Conditions, Extend my Stay or Remain in Canada as a Student.”
      • For visitors: IMM 5708 “Application to Change Conditions, Extend my Stay or Remain in Canada as a Visitor.”

    • Letter of Explanation: Explain how you lost status, why you’re applying late (if relevant), and your intent to comply with all terms in the future.
    • Proof of Previous Status: Copy of your expired permit (study, work, or visitor).
    • Supporting Documents: Documents to show you still meet the requirements for your requested status (enrollment letters, employer offers, updated financial proof, etc.).
    • Passport: Valid and legible photocopy of your passport’s bio page and all pages with stamps or visas.
    • Biometrics: If required, be prepared to pay and provide biometrics again.

Step 3: Apply Online

Submit your application online through the IRCC Secure Account for the fastest, most secure processing. Select the correct option, such as “Restore my status as a worker/student/visitor,” as indicated on the form.

Step 4: Pay the Fees

    • Restoration of Status Fee: $239.75 CAD (as of July 2025).
    • New Permit Fee: $150 CAD for a study or work permit.

Total for Restoration of Status and New Permit: $389.75 CAD.

Additional fees apply if requesting an open work permit ($100) or for biometrics ($85).

Step 5: Wait for a Decision

    • Processing times vary, but most applications take several weeks to a few months.
    • You cannot study or work while your restoration is in process. You must wait for approval and issuance of your new permit before resuming any work or study activities.

If the application is successful, you will receive a new permit and your legal status is restored.

If the application is refused, you must leave Canada or explore other legal remedies.

What If You Miss the 90-Day Restoration Window?

If more than 90 days have passed since losing your status and you’re not eligible for a provincial exemption, you generally must leave Canada and reapply from outside the country. In rare and specific circumstances, options like applying for a Temporary Resident Permit (TRP), Humanitarian and Compassionate (H&C) application, or in-land spousal sponsorship may be explored.
