Canadian Citizenship by Descent Under Bill C-3 | Can X Global

Imagine discovering that you or your children may already be a Canadian citizen, even if you were born thousands of kilometers away from the Great White North. Thanks to Bill C-3, which came into force on December 15, 2025, Canada has dramatically expanded access to citizenship by descent. This change removes the old “first-generation limit” for millions of people worldwide, opening doors for families with Canadian roots.

Whether you have a Canadian parent, grandparent, great-grandparent, or even more distant ancestor, this guide explains exactly who qualifies in 2026 and what steps you can take next.

What Was the First-Generation Limit?

Before Bill C-3, Canadian citizenship by descent was strictly limited. If a Canadian citizen had a child born outside Canada, that child could inherit citizenship. However, if that child (born abroad) later had their own child abroad, the grandchild was generally not eligible. This rule created “Lost Canadians” – people cut off from their heritage despite direct Canadian ancestry.

Bill C-3 addresses this unfairness with retroactive effect for past cases and a balanced framework for the future.

Who Qualifies Under the New Rules in 2026?

1. Born or Adopted Before December 15, 2025

This is the biggest win from Bill C-3. The first-generation limit has been removed for anyone born or adopted before this date.

You may already be a Canadian citizen if:

  • You have at least one Canadian parent (by birth or naturalization in Canada) at the time of your birth.
  • This now extends beyond one generation. You could qualify through a grandparent, great-grandparent, or even further back, as long as you can prove the direct lineage to a qualifying Canadian ancestor.

Key points:

  • No “substantial connection” to Canada is required for these individuals.
  • Citizenship is recognized retroactively from birth.
  • Dual or multiple citizenship is fully allowed. Canada has no restrictions on this.
  • Your ancestor’s dual citizenship status does not affect eligibility.

This change benefits millions, including many in the United States, India, the UK, and other countries with historic Canadian diaspora ties.

2. Born or Adopted On or After December 15, 2025

For newer generations, the first-generation limit is modernized rather than fully removed.

You can acquire citizenship by descent if:

  • Your parent was a Canadian citizen at the time of your birth or adoption.
  • If your Canadian parent was also born or adopted outside Canada, they must demonstrate a substantial connection to Canada: at least 1,095 days (roughly 3 years) of cumulative physical presence in Canada before your birth or adoption.

The 1,095 days do not need to be consecutive or immediately before the birth. Proof can include employment records, tax filings, education documents, or travel history.

If your Canadian parent was born in Canada, no substantial connection test applies. You qualify directly.

How to Prove You Qualify: The Application Process

Even if you are already a citizen under the new rules, you need official proof – typically a Canadian Citizenship Certificate.

Required documents usually include:

  • Your birth certificate.
  • Birth certificates (and possibly marriage certificates) linking each generation back to the Canadian ancestor.
  • Proof of the ancestor’s Canadian citizenship (e.g., Canadian birth certificate, naturalization record, or passport).
  • For post-2025 births: Evidence of the parent’s 1,095 days in Canada.

Applications are submitted to Immigration, Refugees and Citizenship Canada (IRCC). Processing times vary, but having complete documentation speeds things up.

Pro tip: Start with a professional lineage assessment. Missing or unclear documents are the most common hurdles.

Common Scenarios That Now Qualify

  • Your grandfather was born in Toronto, moved abroad, and had your parent abroad – who then had you.
  • Your great-great-grandmother was a Canadian citizen by birth.
  • You were previously told “no” under the old first-generation rule.

Next Steps: Is This You?

  • Gather family documents and build your family tree.
  • Use IRCC’s online tool to check if you may be a citizen.
  • Consult a Regulated Canadian Immigration Consultant (RCIC) or immigration lawyer for a thorough eligibility review.
  • Prepare and submit your proof-of-citizenship application.

Final Thoughts

Bill C-3 represents a historic shift in Canadian immigration policy – one that honors family ties and corrects past injustices. For many, it turns “maybe someday” into “you already are Canadian.”

If you suspect you or a family member may qualify, don’t wait. The earlier you start gathering evidence, the sooner you can claim your Canadian heritage and all the opportunities that come with it.
