Employer Requirements for Getting a Positive LMIA in 2026

LMIA Requirements

Hiring foreign workers through the Temporary Foreign Worker Program (TFWP) can help Canadian employers fill critical labour shortages, but the process begins with one crucial step: securing a positive Labour Market Impact Assessment (LMIA).

A positive LMIA Requirements confirms that no Canadian citizen or permanent resident is available to do the job, and that hiring a temporary foreign worker will not negatively impact the Canadian labour market.

In this blog, we explain what employers need to do to meet LMIA requirements in 2026, including documentation, recruitment, wages, and compliance obligations.

What Is an LMIA Requirements?

A Labour Market Impact Assessment is a document issued by Employment and Social Development Canada (ESDC). It assesses whether hiring a foreign worker for a specific position is justified based on current labour market conditions.

A positive LMIA (also called a confirmation letter) allows the foreign worker to apply for a work permit. A negative LMIA means the employer cannot proceed with hiring from outside Canada under the TFWP.

Who Needs an LMIA requirements?

Employers need an LMIA Requirements if they plan to hire a foreign worker under the Temporary Foreign Worker Program (TFWP), including for occupations such as:

    • General labourers
    • Construction workers
    • Farmworkers
    • Cooks and kitchen staff
    • Truck drivers
    • Caregivers

LMIA is not required under the International Mobility Program (IMP), which includes LMIA-exempt categories such as intra-company transferees, spousal work permits, and free trade agreements.

Employer Requirements for a Positive LMIA in 2026

To receive a positive LMIA Requirements decision in 2026, employers must meet several key requirements. These fall into the following categories:

1. Business Legitimacy

You must prove that your business is active and capable of hiring a foreign worker. This includes:

    • Valid Canada Revenue Agency (CRA) business number
    • Recent business license
    • Payroll documents (T4 summary, T2 or T2125)
    • Commercial lease or utility bills
    • Proof of ability to pay the worker’s wages

2. Genuine Job Offer

The job offer must be real, full-time, and aligned with the employer’s ongoing business needs. It should match the duties and requirements listed under the National Occupation Classification (NOC) system.

Key details must include:

    • Job title and NOC code
    • Wage rate and benefits
    • Hours per week (generally 30+ hours)
    • Duration of employment
    • Location of work
    • Main job duties

3. Wages and Working Conditions

Wages offered must be in line with the median wage for the occupation and region, as published on Job Bank. ESDC will assess whether:

    • The wage meets or exceeds the prevailing wage
    • Working conditions are safe and consistent with Canadian labour laws
    • The employee is not being underpaid or exploited

4. Recruitment Efforts

Employers must prove that they tried and failed to recruit Canadian citizens or permanent residents before turning to foreign workers.

Mandatory recruitment requirements typically include:

    • Job posting on Job Bank
    • At least two other recruitment methods (e.g. Indeed, LinkedIn, industry-specific sites)
    • Job must be advertised for at least 4 consecutive weeks within 3 months before applying
    • Must be actively available at the time of application

Employers must also provide a recruitment summary explaining why Canadian applicants were not hired.

5. Transition Plan (for High-Wage Positions)

For high-wage LMIA applications, employers must submit a transition plan explaining how they will reduce reliance on temporary foreign workers over time. This can include:

    • Training Canadians for the role
    • Helping the foreign worker become a permanent resident
    • Developing a long-term recruitment strategy

This requirement does not apply to low-wage positions.

6. Cap on Low-Wage Workers

Employers hiring low-wage workers (those below the median provincial wage) are subject to caps:

    • Maximum 20% of workforce can be low-wage foreign workers
    • Exceptions apply to seasonal work, primary agriculture, and caregiver positions

Wages must meet or exceed minimum wage and be consistent with market conditions.

7. Employment Contracts and Benefits

Employers must provide a signed employment contract to the worker, outlining:

    • Job duties
    • Duration of employment
    • Wages and deductions
    • Overtime pay
    • Vacation and leave entitlements
    • Workplace safety coverage (e.g. WorkSafeBC or WSIB)

8. Employer Compliance History

ESDC will review the employer’s past compliance with the TFWP, including:

    • Timely payment of wages
    • Proper working conditions
    • Retention of required documents
    • No prior violations or bans under the program

Employers who have been found non-compliant in the past may be ineligible to submit new LMIAs.

Processing Times and Application Fees

    • Standard LMIA work permit processing time: Varies by occupation and location, typically 6 to 8 weeks
    • LMIA application fee: $1,000 per position
    • Exemptions: No fee for caregivers under certain streams and agricultural employers under the Seasonal Agricultural Worker Program (SAWP)
