Nobody plans to overstay. It usually happens because someone did not understand the rules clearly, lost track of their authorized stay date, or was hoping the situation would resolve itself. It does not resolve itself. But it is also not necessarily the end of the road.

What Overstaying Actually Means
Overstaying means you remained in Canada past the date your authorized stay ended. This is different from your visa expiry date, which is a common source of confusion. Your authorized stay is shown on your entry record or permit document. That is the date that matters. The moment that date passes and you have not left Canada or applied to extend your status, you are technically without status.
Are You Immediately Deported?
No. Canada does not have automatic deportation for people who overstay. There is no officer who shows up at your door the morning after your status expires. However, being without status in Canada is a real legal situation with real consequences. The longer it goes on, the more serious those consequences become.
What Actually Happens When You Overstay
Your Record Is Flagged
Canada’s immigration system tracks entry and exit data. If you are in Canada without valid status, that information can be accessed by IRCC and CBSA officers when you interact with them, whether at a border crossing, a status application, or any future immigration application.
You Cannot Legally Work or Study
If your work permit or study permit has expired, you cannot legally work or study in Canada. Doing so is a separate violation on top of the overstay, and it compounds the consequences significantly.
Future Applications Become More Difficult
Every future immigration application, whether for a new work permit, a visitor visa, a study permit, or permanent residency, includes questions about your immigration history. A period of unauthorized stay in Canada must be disclosed. Failure to disclose it is misrepresentation, which is a far more serious problem than the overstay itself.
The 90-Day Restoration Window
Here is the most important number to know: 90 days. If you have lost your status in Canada, you have 90 days from the date you lost it to apply for restoration of status. This application, if approved, brings you back into valid status.
Restoration is not guaranteed. IRCC will look at why you lost status and whether you meet the requirements for the status you are trying to restore. But it is a real path available to many people. If you are inside that 90-day window right now, that is where your energy should go. After 90 days, restoration is no longer an option.
What Happens When You Try to Leave Canada?
When you leave Canada, CBSA officers process your departure. If your records show that you overstayed your authorized stay, this will be on file. Depending on the length of the overstay and the circumstances, you could face a formal notation in your immigration record, difficulty re-entering Canada in the future, or in more serious cases, a formal removal order or a finding of inadmissibility. The longer the overstay, the more serious the potential outcome at the border.
What If You Did Not Realize You Were Overstaying?
This happens more often than you might think. Someone enters Canada as a visitor and assumes their six-month stay starts from when their visa expires, not from when they entered. In these situations, the fact that it was unintentional does matter to some extent. IRCC and CBSA do consider context.
However, not knowing is not a complete defense, and it does not erase the overstay from your record. What it can do is help when you are explaining your situation in a restoration application or in a future visa application, especially if the overstay was short and you took action to address it as soon as you became aware.
What You Should Do Right Now
Figure out exactly when your authorized stay ended. Check your entry record, your permit, or your IRCC account. Get the exact date.
Calculate how many days have passed since that date. If you are within 90 days, you have a restoration option available.
Stop working or studying if your permit has expired. Continuing to work without authorization makes your situation significantly worse.
Talk to a regulated immigration consultant before you do anything else. The path forward depends on your specific situation, how long you have been out of status, and what type of visa or permit you originally held.
