Who Is Eligible for the SOWP in 2026?

Historically, only inland applicants could access the SOWP through the sponsorship process. A 2023 IRCC public policy changed this. Since May 2023, outland applicants who are physically present in Canada with valid temporary status can also apply for the SOWP. This policy has been extended and remains in effect through December 31, 2026.
In practical terms, a sponsored spouse who is in Canada on a visitor record and whose file is being processed as an outland (Family Class) application can still receive a SOWP after their AOR arrives. This combination makes the outland-from-within-Canada strategy one of the most advantageous approaches available in 2026.
One important distinction: outland applicants who are outside Canada cannot receive a SOWP through the sponsorship process. The permit requires physical presence in Canada. An outland applicant abroad would need to qualify for a separate work permit through another pathway if they need to work in Canada before their PR is approved.

The sponsored person must maintain valid temporary resident status in Canada from the moment the sponsorship application is submitted until the SOWP is received. There is no automatic authorization to remain in Canada solely because a sponsorship application is in process, unless the person is already maintaining status through their own temporary permit.
If the sponsored person’s visitor record, work permit, or study permit is approaching expiry, apply for an extension at least 30 days before the current status expires. When an extension application is filed before the existing status expires, the person is in a period called maintained status and can legally remain in Canada and continue their current activities while the extension is being assessed. Do not allow status to lapse.
If status has already expired, IRCC has a two-week exception for urgent SOWP situations: if the AOR arrives and temporary status expires within 14 days, the SOWP application can still be submitted even before the AOR is technically confirmed. SOWP Extension: What to Do Before It Expires
If the SOWP is issued and the PR application is still in process as the permit’s expiry date approaches, a two-year extension is available. Apply for the extension before the SOWP expires. Do not wait until after expiry. As with all status documents in Canada, applying before expiry keeps the person in maintained status, allowing them to continue working while the extension is assessed.
